Bakugan Marketplace is a community-driven platform that helps collectors connect with sellers. We do not sell products, process payments, hold inventory, provide escrow services, arrange shipping, or act as an intermediary in transactions.

By using this website, you agree to these Terms of Service.

2. Role of the Platform

Bakugan Marketplace:

• Displays seller-submitted listings
• Provides seller contact information
• Helps buyers discover available Bakugan from community sellers
• Does not inspect, verify, authenticate, guarantee, or endorse any seller, item, listing, price, or transaction

All transactions occur directly between buyers and sellers. Bakugan Marketplace is not a party to any sale.

3. No Responsibility for Transactions

We are not responsible for:

• Payment disputes
• Shipping issues
• Lost, damaged, delayed, or undelivered items
• Product quality, condition, or authenticity
• Returns, refunds, cancellations, or chargebacks
• Scams, fraud, misrepresentation, or impersonation
• Disputes between buyers and sellers

Users engage with sellers and buyers at their own risk.

4. Seller Responsibilities

By submitting information to Bakugan Marketplace, sellers agree that:

• All information they provide is accurate, complete, and not misleading
• They have the legal right to sell the items they list
• They are responsible for accurately describing item condition, authenticity, price, availability, shipping terms, return terms, and any known defects
• They are responsible for complying with any laws, taxes, customs rules, shipping restrictions, and consumer protection requirements that apply to their sales
• They are responsible for handling buyer questions, payments, shipping, returns, refunds, and disputes directly with buyers
• They must not list stolen, counterfeit, unsafe, prohibited, restricted, or misrepresented items
• They must not impersonate another seller, collector, business, or community member
• They understand that submitted contact and listing information may be publicly displayed on BakuganMarketplace.com

Bakugan Marketplace may remove seller listings at any time, with or without notice, especially if a listing appears suspicious, misleading, harmful, inactive, or in violation of these Terms.

5. Buyer Responsibilities

Buyers agree that:

• All purchases are made directly between the buyer and seller
• Bakugan Marketplace does not inspect, verify, guarantee, authenticate, or hold inventory
• Buyers are responsible for reviewing item details, seller information, price, shipping terms, return terms, and refund terms before buying
• Buyers should ask sellers for photos, proof of ownership, condition details, references, and any other information needed before payment
• Buyers should use secure payment methods with buyer protection, such as PayPal Goods & Services
• Buyers understand that using payment methods without buyer protection may increase the risk of loss
• Buyers are responsible for understanding their own local laws, customs rules, taxes, import fees, and delivery risks

6. Returns, Refunds, and Disputes

Bakugan Marketplace does not process payments, manage shipping, hold funds, provide refunds, or decide disputes.

Return, refund, cancellation, and shipping terms must be handled directly between buyer and seller. Sellers are responsible for clearly communicating their return and refund terms before a sale. Buyers are responsible for reviewing those terms before purchasing.

Nothing in these Terms is intended to limit any legal rights that may apply under consumer protection laws. Where applicable law gives a buyer rights that cannot be waived, those laws may override a seller’s stated policy.

7. Prohibited Use

You may not:

• Submit false, incomplete, or misleading information
• Impersonate another person, seller, collector, or business
• Use the platform for illegal, fraudulent, abusive, or harmful activities
• List stolen, counterfeit, unsafe, prohibited, restricted, or misrepresented items
• Attempt to scam, harass, threaten, exploit, or mislead another user
• Attempt to harm, disrupt, overload, scrape, copy, or exploit the platform
• Use the platform to avoid accountability after a transaction has started

8. Reports and Suspicious Activity

Users may report suspicious listings, scams, impersonation, counterfeit items, misleading information, abusive behavior, or other concerns by contacting [email protected].

We may review reports and remove listings or sellers at our discretion, but we are not obligated to investigate, mediate, or resolve disputes between users.

9. Removal of Listings

We may remove any listing, seller, or submitted information at our discretion, including for:

• Violations of these Terms
• Suspicious or harmful activity
• Community complaints
• Inactive, outdated, or inaccurate listings
• Listings that may create risk for buyers, sellers, the community, or the platform

10. Limitation of Liability

Bakugan Marketplace is provided "as is" without warranties of any kind.

To the fullest extent permitted by law, we are not liable for any damages, losses, disputes, claims, or costs resulting from:

• Use of the platform
• Transactions between users
• Inaccurate, outdated, incomplete, or misleading information
• Seller conduct or buyer conduct
• Payment, shipping, return, refund, or authenticity disputes
• Third-party services or external links

11. External Links and Services

We may link to third-party platforms such as Discord, PayPal, Google Forms, Google Sheets, social media, or other external services. We are not responsible for those services, their policies, their actions, or any issues that happen on those platforms.

12. Changes to Terms

We may update these Terms from time to time.

When changes are made, we will update the effective date on this page and provide reasonable notice, such as posting a visible notice on the website.

Continued use of Bakugan Marketplace after updated Terms are posted means you accept the updated Terms.
